Marilyn Cade resigns from ICANN Nomcom

Michael Froomkin reports that Marilyn Cade has resigned from the ICANN Nomcom … to run as a candidate for the GNSO consituency. The ICANN legal counsel considers she is not eligible, based on Article VII, Sec. 8 of the ICANN bylaws.

More pragmatically, it should be noted that the formal call for statements of interest was issued on Apr 18th and her resignation from Nomcom happened on the 27th. During those 9 days, Ms Cade, as a Nomcom member, could potentially see the statements of interest of other candidates.

Obviously, she would have an unfair advantage over other potential candidates.
