At the ICANN board meeting today, three resolutions were passed supporting the work of the GNSO whois task force and a definition of Whois. I tend to agree with the definition and I do not think the whois databases are sufficient reliable to help in law enforcement as some governments would like to use it.
While the ICANN community has been discussing the whois issues for the last six years, nothing much happened in terms of implementation. At this stage, many whois services are breaking privacy laws. The ICANN community loves to talk. This is the IETF heritage, I guess. The governments have been very patient while waiting for the techncal community to fix the issues and comply with the law.
Will it require a legal action against a whois service provider before the ICANN community realizes it cannot just keep talking and should actually implement the legal requirements. If they can’t, maybe the whois service should be put on-hold until the technical community has sorted it out.
